1. Agreement to Terms

By accessing or using the website at adinsta.ai, utilizing the AdInsta demand-side platform, integrating the AdInsta SDK, or participating in the AdInsta affiliate network, you agree to be bound by these Terms of Service. If you are entering into this agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity.

2. Services Provided

AdInsta provides digital advertising infrastructure and services including:

• Proprietary Mobile DSP: Real-time bidding, optimization, and media buying across AdInsta-owned apps and direct SDK publisher inventory.
• Affiliate Performance Network: Quality-controlled affiliate app traffic on CPI, CPA, and CPL payout models.
• Publisher SDK: Monetization SDK enabling mobile application developers to receive direct brand and programmatic demand.

3. Anti-Fraud & Traffic Quality Policy

AdInsta operates under a zero-tolerance policy regarding illegitimate, automated, or fraudulent traffic. All network traffic is monitored via our proprietary fraud stack and third-party measurement integrations (AppsFlyer, Adjust, Kochava).

• Affiliates and publishers must strictly disclose incentivized vs. non-incentivized traffic streams.
• Practices including click injection, click spamming, device emulators, farm installations, and SDK spoofing will result in immediate account termination, forfeiture of payouts, and legal action.
• Traffic flagged as fraudulent by verified MMP reports is subject to clawback and reconciliation.

4. Billing, Payouts & Reconciliation

Campaign invoicing and affiliate payouts are reconciled based on log-level event data validated by the designated Mobile Measurement Partner (MMP). Payment terms for managed DSP buyers and verified affiliate partners are standard Net 30 unless otherwise agreed upon in a signed Insertion Order (IO).

5. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Singapore, without regard to its conflict of law principles. Any dispute arising out of or in connection with these Terms shall be referred to and finally resolved by arbitration administered by the Singapore International Arbitration Centre (SIAC).
